Large and impressive 28x42" poster issued by DC Comics advertising the upcoming issue of Superman #10 (May-June 1941), showing the top half of Fred Ray's cover (although the falling woman has been obscured by large "10¢" price) w/text reading in part "Hey Kids The New Superman Is Out - Get Your Copy Now." Poster has been folded as issued and has some splits at fold crease intersections w/small split along fold lines and at edges of fold lines. Fine overall. Extremely rare and the only known example of this promotional poster. Making this piece even more historically important is that fact that it was presented as evidence at the Superman/Captain Marvel copyright trial. Fawcett Publications debuted their superhero character Captain Marvel in Feb. 1940, whose powers and abilities immediately caught the notice of DC Comics for the somewhat glaring similarities to their own character Superman. Not only were they similar in their abilities, but more than a few times the Captain Marvel team lifted panels or concepts directly from Superman stories. After a cease and desist order in 1941 was ignored, DC Comics and Superman, Inc. formally filed a lawsuit in Sept. 1941 against Fawcett and Captain Marvel for copyright infringement. Due to both normal legal wrangling and World War II, depositions for this lawsuit stretched until after the war was over, w/the trial finally taking place in March 1948. As part of this famous lawsuit, this Superman poster was entered into evidence in support of testimony by Jack Liebowitz, co-owner of DC Comics, who testified about the sales and marketing of Superman from Aug. 14-23, 1946. Back of poster has handwritten ink notation reading "Defn. Fawcett's Exhibit L-9 - Liebowitz Deposition - 8/20/46 EAM." The legal importance of this poster, added to the fact that it is the only example extant presents an extraordinary opportunity to obtain a truly rare Superman piece of history.
